2 Men Killed in Sacramento County Trucking Accident

KCRA NBC News has reported that 2 men have been killed in a trucking accident overnight. The crash took place on Highway 99 in Sacramento County. Per NBC, three commercial vehicles, including a FedEx truck, were involved in the accident. CHP is still conducting an investigation, however, preliminary reports state that a large big rig slammed into the back of the smaller truck, killing the two passengers. The names of the victims have not been released yet. One of the men was 33, and the other was 20. Tragic accidents like this happen far too often. Our law firm extends our condolences to both victims' families.

Situations like this also create complicated legal matters. From filing a wrongful death claim to taking on a large national trucking company, obtaining the justice your loved ones deserve isn't easy. We can help. Our Elk Grove and Sacramento County personal injury attorneys have fought for the financial rights of accident victims for over 30 years. The accident above brings about multiple potential issues. First, a wrongful death lawsuit will most likely need to be filed. Second, there are three commercial trucks involved. Finally, the third potential issue deals with proving fault. In this article, we are going to discuss why hiring a personal injury lawyer in Sacramento might be beneficial when dealing with complex accident claims.

Hiring a Sacramento County Personal Injury Attorney to Handle a Complex Injury Case

As we mentioned above, first and foremost, our hearts and prayers go out to the victims and their families. Horrific accidents like this are often avoidable. It's normal to feel angry, sad, and confused after losing a friend or loved one in an accident in this manner. In addition, you may have the desire to seek justice, to fight to get those at fault to be held accountable for their actions. With emotions running high, it may be best to retain the legal help of a law firm. Hiring a Sacramento County personal injury attorney to handle a complex injury case may be a good idea.

CBS also published an article about the crash. Their report provided more information related to the driving actions that may have caused the crash. Per CBS, a 43-year-old man was driving a freight tractor at 55 miles an hour while the freeway traffic was moving at 5 miles an hour ahead of him. Unable to slow down, the driver of the freight tractor slammed full speed into a Chevy Silverado, fatally injuring both the driver and passenger inside. In addition, there were two other commercial vehicles involved.

There are many potential hurdles that a family could face if they pursued an injury claim in this case. Let's discuss a few of them and why hiring a Sacramento County personal injury lawyer to represent your claim may be beneficial.

Proving Fault

When multiple vehicles are involved in a crash, it can be very difficult to prove fault. Proving fault is vital to filing an injury lawsuit. The legal world calls these types of accidents "chain reaction crashes." When one car hits another, it's usually pretty obvious which driver is at fault. Both drivers (assuming both follow the driving laws of California) exchange insurance. The person at fault's insurance company contacts the victim, and the claim process begins.

However, in situations where there are multiple cars involved, it is not as easy to determine fault. Say one car gets pushed into another. Perhaps one car cut another one-off, causing that car to crash into a third vehicle. You can begin to see how complicated and messy this can get. Hiring an experienced Elk Grove and Sacramento County car accident lawyer, who understands the issues surrounding complex injury cases, might make the difference between getting paid or getting the short end of the stick.

Large Injury Settlements

Insurance companies love to tell us they care. They come up with catchy jingles and television ads. State Farm tells us that they are "here to help life go right." Allstate asks us "if we are in good hands." It seems like they really do care about us. Unfortunately, that's not the case. Insurance firms are financial institutions. They make billions of dollars by investing the money we pay them. They lose money paying out on injury claims. Sadly, in situations such as the accident that took place last night, insurance companies may weigh the opportunity cost.

Essentially, insurance companies employ risk analysts and adjusters. Part of their job is to decide if paying out a claim will cost them less than fighting a claim. They also hire powerful attorneys to represent these interests in court. In situations where a wrongful death claim is filed, or if a commercial trucking company is at fault, it could take the claim into millions of dollars. These types of large injury settlements can trigger an insurance company to fight until the end.

Filing a Wrongful Death Claim

Out of all of the reasons why you may want to hire an attorney, filing a wrongful death claim is number one, in our opinion. These types of lawsuits tend to go to court. When insurance companies receive a multi-million dollar payout request, they put up a fight. Wrongful death lawsuits take time, and they can cause all sorts of headaches. Remember, you and your family just lost a loved one. Do you really want to argue and fight with a lawyer who is trying to downplay your loss or, worse, blame your loved one for the accident? No, you need time to grieve and heal.
